Trip and Fall Injury at Live-In Care Facility

This case involved a woman who suffered serious injuries after tripping and falling while entering a live-in care facility. The cause of the fall was an uneven sidewalk that had not been brought up to city code standards. Such unsafe property conditions created a hazardous environment for both residents and visitors.
Premises liability cases like this often hinge on whether a property owner took reasonable steps to maintain safe conditions. In this matter, the facility’s failure to correct the sidewalk defect made it clear that their negligence directly contributed to the injury.

Challenge

One of the main challenges in this case was the available video footage. The CCTV angle did not clearly capture the defect in the sidewalk, making it difficult to demonstrate to a jury how the condition caused the fall. Our team had to:

Reconstruct the scene from a new perspective to clearly show the hazard.

Collaborate with expert witnesses to ensure all measurements were accurate.

Overcome defense arguments that the condition had been corrected after the incident

Visual Strategy

Our approach emphasized the facility’s ongoing failure to comply with city safety standards:

  • At the time of the incident, the sidewalk was not up to code, creating a dangerous trip hazard.

  • Even after post-incident surface grinding, the area still failed to meet city compliance requirements.

  • The visuals clarified these violations, underscoring the property owner’s negligence and responsibility.

Our Work

To build a compelling case presentation, our visual strategy included:

  • Aerial and CCTV Footage Overview to place the jury at the scene.

  • Camera Match Technology to align original video footage with accurate 3D reconstruction.

  • 3D Animation (Non-Character) to show the hazardous condition and code violations in a clear, visual format.

Results

The combination of expert testimony and our detailed visual strategy made it clear that the unsafe property conditions were the direct cause of the client’s injuries. The strong visuals helped the legal team present a persuasive case, ultimately strengthening the premises liability claim and holding the care facility accountable.

Testimonial

"I have used Iconographics on 2 cases now. The most recent case being a trip and fall case where we used them for liability visualization and also to show the jury a cervical spine surgery. We sent it to opposing counsel a month before trial, and the Defendant came up with 2.5 times their last offer to get the case settled. Iconographics' visualizations helped get both cases settled. Definitely going to use them much more in the future." - Wes Eddington
